Generally. NESTR may collect information that can identify you through its Sites (as defined in the Terms of Use), including without limitation, identifying information, such as your name, address, email address and telephone number, photos of you, your location, your access and use the Sites, and, if you transact business with us, financial information (collectively “Your Information“).

Third Party Access. NESTR may ask your permission to access Your Information through third party accounts, such as Facebook, and permission to access your location when you download or use the Sites. NESTR may also obtain both personal and non-personal information about You from other businesses, business partners and other third parties. If you communicate with any other user of the Sites or NESTR Customer Service through any functionality of the Sites, the content such communications may be available to and stored by NESTR. By using the Sites, You understand and agree that your Information may be transferred to our facilities and directly or indirectly to/from third party who may access your Information to perform services for NESTR. If you access our Sites from a third party social platform, such as Facebook, NESTR may share non-personal information with that platform to the extent permitted by your agreement with it and its privacy settings.

Data Collection. By using the Sites you authorize NESTR to collect and retain your Information, which solely for operating the Sites, may be distributed to servers in the United States and abroad if you visit the Sites from outside the United Stated. When you visit our Sites or use a NESTR application (“App”), NESTR may automatically collect your browser and device information, including your IP address, device ID and type, your browser type and language, the operating system used by your device, access times, and your location. NESTR may also use various technologies to collect information from your device and about your activities on our Sites and App. NESTR may assign cookies to your device and use pixel tags (invisible graphics) on the Sites, all of which may automatically collect information about your activity on our Sites. You can control information collected by cookies by deleting or declining cookies by changing your browser settings. If NESTR advertises, NESTR (or third parties) may use certain data collected on our Sites to show you certain third party ads.

NESTR Apps. If you are using a NESTR App, we may use Device IDs to recognize you and may store your preferences and track your use of the App. Device IDs cannot be deleted. Analytics companies may use device IDs to track information about your usage of the NESTR App. NESTR may deliver notifications to your phone or mobile device. You can disable these notifications by going into “App Settings” on the App or by changing the settings on your mobile device.

Advertising. NESTR may allow third parties to display advertisements on the Sites. NESTR may or may not, in its sole discretion provide any anonymous personal information to third parties. Third-party advertisers may be members of the Network Advertising Initiative or similar group, which offers a single location to opt out of ad targeting. Opting out will not decrease the number of advertisements that may appear on NESTR Sites.

Use of Data Collected. NESTR may use Your Information to: deliver and improve its services and the Sites; manage your account and provide You with customer support; perform research and analysis about your use of, or interest in, NESTR Sites; communicate with You about NESTR or third party services; develop, display, and track content tailored to You; perform website or mobile application analytics; verify your real estate license information; and enforce NESTR’s Terms of Use and any other legal rights.

Information Sharing. When you register as a user of NESTR, your NESTR Profile will be viewable by other users of the Sites. NESTR does not share your Information with others, except as stated in this Privacy Policy, or when NESTR informs you and provides you with an opportunity to opt out of having Your Information shared. NESTR may also share personal information as follows:

  1. Vendors/Servicers. Third parties that perform certain services for NESTR, including without limitation, fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, analytics, member screenings, and supporting our Site functionalities.
  2. Legal Proceedings. In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.
  3. Appropriate Disclosure. When NESTR believes disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Terms of Use or other agreements or policies.
  4. Business Purpose. For any of its business purposes, including without limitation, a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

Do Not Track Disclosure. Do Not Track (“DNT”) is a privacy preference that users can set in their web browsers. NESTR does not track your use over time or with third party websites and therefore will not recognize or respond to DNT signals.

Third Party Websites. NESTR may choose to provide links to third party websites which do not operate under this Privacy Policy, and which NESTR does not control in any respect. Should you choose to visit a third party website through the Sites, these third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. NESTR recommends that you consult the privacy statements of all third-party websites you visit.

Changes to Your Information. You will be able to review and update Your profile and account settings with NESTR. You may choose to not provide certain information, but this may result in a limited ability to access NESTR functionalities. If you close your account, NESTR will retain certain information associated with your account for analytical purposes and recordkeeping integrity, enforce our Terms of Use, to take actions NESTR deem necessary to protect the integrity of our Sites or our users, and/or to take other actions otherwise permitted by law. In addition, if your Information was provided to third parties subject to this Privacy Policy, retention of such information will be subject to those third parties’ policies.

Information Safety. NESTR may take certain measures to help safeguard your Information from unauthorized access. However, no system can be completely secure. Therefore, NESTR does not promise, and you should not expect, that your Information, including communications through our Sites, will always remain secure. You should always take care with how you handle and disclose your personal information and should avoid sending personal information through insecure email. Information You Post. NESTR may provide areas on our Sites where you can post information about yourself and others and communicate with others. Such postings are governed by our Terms of Use. When you voluntarily disclose personal information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. NESTR cannot control who reads your postings or what other users may do with information that you voluntarily post. NESTR strongly encourages you to exercise discretion and caution with respect to Your Information.

Children’s privacy. NESTR restricts the use of our Sites to individuals age 18 and below. NESTR does not knowingly collect, maintain, or use personal information from children under the age of 18.

No Rights of Third Parties. This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the website.

Changes to this Privacy Policy. NESTR will occasionally update this Privacy Policy. NESTR recommends that you check our Sites from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.
